Evil Abu Hamza will die behind bars after his bid to escape his life sentence and return to Britain’s streets was rejected by a US court.
Despite his pleas for compassionate release, a judge said the hook-handed terrorist is as dangerous today as when he was sent to America’s supermax prison. The hate preacher – known in America as Mostafa Mostafa – had demanded he be set free over the strict conditions in which he claimed to be held.
The ex-Soho stripper bouncer, who was caught by warders indoctrinating jihad into his young granddaughter, insisted he be released immediately on compassionate grounds after submitting hundreds of pages of complaints as to why. His wife even told a judge: “It is now time for him to come back home to his family, where he truly belongs.”
Meanwhile, his kids portrayed him as a loving man who is “one of the most intellectual and upright men you could come across”. They add: “He influences us to be charitable and helpful to others, Muslims and non-Muslims alike.” But a judge has seen through the family claims ruling Hamza “ha[s] not had a change of heart since” he was found guilty of deadly terror offences that saw him sentenced to life in prison without parole.
In her ruling, New York Justice Analisa Torres agreed that she had “every reason to believe that if [he] were free,” he would continue to “support and inspire others to acts of violence.” She wrote: “Although the Court recognizes that Mustafa’s disabilities make life in an exceedingly difficult place even more trying, Mustafa has not demonstrated that he no longer poses a danger to the public, so the Court cannot in good conscience order his release.”
She added she was “disturbed by the BOP’s failure to provide Mustafa with certain treatments and accommodations that appear medically necessary and that do not seem to pose a security concern.” But Judge Torres said she was convinced not to allow Hamza to be released, given the seriousness of his crimes.
She added: “Mustafa’s offences of conviction are of the most serious kind. He assisted a hostage kidnapping that resulted in the deaths of four people and attempted to organize a camp to train future terrorists. Beyond these offences, Mustafa spent years preaching uncompromising violence against non-Muslims. Importantly, Mustafa never expressed regret for his statements or crimes, maintaining his innocence even after he was convicted.”
She concluded: “For the foregoing reasons, Mustafa’s motion is DENIED.” Prison sources told the Mirror the decision left Hamza “furious”, seeing him file an immediate appeal. At the time he launched his freedom bid, feckless Hamza argued he should be released from Colorado’s supermax prison ADX Florence – known as the Alcatraz of the Rockies – where he is held in solitary confinement.
His lawyers detailed the conditions they claimed the life prisoner has suffered and what they allege prison officers have turned a blind eye to.
The 66-year-old’s lawyers accused wardens of “using the existence of the prostheses as an excuse not to provide the necessary accommodations and assistance it promised the extradition courts.” They claim his false arms harnesses were “being held together by shoestring”. His legal team stated that he was initially held in “cell 300,” which is “a modified large storeroom.”
“While the cell has two windows, one is blocked by the shower that was installed, and the other is an interior window,” his appeal states. “Mr Mostafa had no natural light. The other cell in which Mr Mostafa has been confined does not have a proper toilet for his disabilities, nor a shower or sink with hands-free access to water, which he also requires.”
Among other problems in Cell 300, prison staff welded sharp round metal discs to the faucets “to make it easy” for him, but “the discs cut into his stumps and caused bleeding.” The toothless terrorist’s feet were said to be in such terrible condition he experienced “frequent bleeding in his feet from sharp or overgrown toenails”. Diabetic Hamza is claimed to “spend his entire day, every day, in solitary confinement without assistance from anyone.”
The papers add: “As a result of the lack of accommodations and care, Mr Mostafa has lost almost all of his teeth, suffers from multiple infections, and has consistently been without the medical care considered reasonable to any civilized society.” As part of his bid to be sent home a free man, his family wrote letters to the Southern Court in New York, where in 2015, he was sentenced to life in prison for terrorism offences.
All paint a picture of a loving father, not a man convicted of trying to create a terrorist training camp to teach others to carry out death and destruction as he was found guilty of. His son, Imran Mostafa Kamel, once charged with firearms offences after a London bouncer was killed, wrote: “I am in desperate need of his presence, love, and unwavering support.
“To witness his reunion with our precious grandchildren and to enjoy quality time together as a family would be a dream come true. I firmly believe that his return is not just a personal desire but a necessary step towards healing and rebuilding what we have lost during these unbearable years.”
Hamza’s wife, Najat Chaffe, said of her terrorist husband: “Our family has been deeply distressed by his absence, as he has left an irreplaceable void that no one can fill. The yearning to have him back in our lives has only intensified over time, and his grandchildren, myself, and our children have missed him dearly. As his devoted wife, I have spent countless years alone, shouldering the immense responsibility of raising our children and providing for their day-to-day needs.
She went on: “The toll it has taken on me, both mentally and physically, has been overwhelming. My heart longs for the support and companionship Mr Mostafa would offer during my difficult moments. It is now time for him to come back home to his family, where he truly belongs.”
Hamza was convicted in 2015 in New York over his role in the 1998 kidnapping in Yemen of 16 foreign tourists, of whom four were killed, and of conspiring to set up a militant training camp in Bly, Oregon, in late 1999. He was also found guilty of providing material support to bin Laden’s terror network, of wanting to set up a computer lab for the Taliban and sending recruits for terror training in Afghanistan. Hamza was sentenced to life in prison, being told he would die behind bars by the judge.
